Any data or information that is shared by you that is incomplete, inaccurate, false, or if the information or data you provide is damaged during submission, you and any Company you may represent (and not JobsRUs or its Affilates will be fully liable for any Claims (as defined below) that may arise as a result.

10.0 Release of Liability.

To the fullest extent of the law, JobsRUs and its Affiliates will not be liable for any use of the Website, for any reason. Said differently, to the fullest extent of the law, under no circumstances will JobsRUs and its Affiliates be responsible for any damages, income, profits, costs, fees, losses (including, but not limited to, economic, special, incidental, indirect, or consequential) or otherwise incurred as a result of you or any Companies’ use of the Website. Regardless whether a Claim is brought under negligence, strict liability, contract, tort, or any other legal theory of law or equity that arises out of the use of the Website. Therefore, the Website should be used at your own risk.

 

Without limiting the foregoing, in the event that the above paragraph is limited by state or local law, JobsRUs and its Affiliates liability MAY NOT exceed One Hundred and Fifty Dollars ($150) or the amount paid to JobsRUs and its Affiliates for use of the Website, whichever is less.

 

11.0 Indemnification.

 

You agree to indemnify, defend, and hold harmless the Indemnities from and against any and all Claims which arise, relate or occur due to use of the Website.

 

12.0 Governing Law.

 

The Website, these Terms and Conditions, and the Privacy Policy, are governed solely by the state of Georgia, and applicable federal laws of the United States of America.

 

Any Claim arising out of these Terms and Conditions, the Privacy Policy, or use of the Website shall be resolved through binding arbitration administered by a sole arbitrator through the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Atlanta, Georgia.

 

13.0 Entire Terms and Conditions.

 

These Terms and Conditions and the Privacy Policy is the complete understanding between you and JobsRUs and its Affiliates regarding the use of the Website. There does not exist any further oral, written or other agreements between the you and JobsRUs or any Company you may represent.

 

In the event that any part of these Terms and Conditions or the Privacy Policy is found to be unlawful, void or unenforceable, then that provision shall be severed from the remaining parts of these Terms and Conditions or the Privacy Policy, and these Terms and Conditions and Privacy Policy shall continue in full force.

 

14.0 Term.

 

These Terms and Conditions and the Privacy Policy shall survive indefinitely until terminated by JobsRUs.

 

15.0 Assignment.

 

These Terms and Conditions, the Privacy Policy, and obligations hereunder may not be assigned by you without the prior written consent of JobsRUs. However, JobsRUs may assign its rights or these Terms and Conditions, without your consent or the consent of any Company you represent.

 

16.0 Waiver.

 

No action or inaction by JobsRUs shall operate as a waiver or consent to a breach of these Terms and Conditions or the Privacy Policy, unless in writing and signed by both parties.
